1. scope of application

For all deliveries from vision-orange.com to consumers (§ 13 BGB) these general terms and conditions (AGB) apply. A consumer is any natural person who concludes a legal transaction for a purpose that can neither be attributed to his commercial nor his independent professional activity.

2. contracting party

The purchase contract is concluded with Orangen-Bitter GbR, Thomas König and Germar Pflug, Markt 10, 06785 Oranienbaum. You can contact our customer service for questions, complaints and objections by e-mail at post@vision-orange.com.

3. offer and contract conclusion

3.1 The presentation of the products in the online shop is not a legally binding offer, but an invitation to order. Errors excepted.
3.2 By clicking on the order button in the last step of the ordering process, you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail immediately after receiving your order.

4. right of withdrawal

Consumers have a fortnightly right of withdrawal. Cancellation policy Right of cancellation: You can cancel your contractual declaration within 14 days without giving reasons in writing (e.g. letter, fax, e-mail) or - if the goods have been delivered to you before the end of this period - by returning the goods. The time limit begins after receipt of this notification in writing, but not before receipt of the goods by the recipient (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also does not fulfill our obligations under Article 246 § 2 in conjunction with § 1 para 1 and 2 EGBGB and our obligations under § 312e para 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. The timely dispatch of the revocation or the goods is sufficient to comply with the revocation period. The revocation is to be addressed to: Orangen-Bitter GbR, Thomas König and Germar Pflug, Markt 10, 06785 Oranienbaum.

Consequences of revocation:
In the event of an effective revocation, the services received by both parties are to be returned and any benefits derived (e.g. interest) surrendered. If you are unable to return the received goods or services in whole or in part or only in a deteriorated condition, you may have to pay compensation for lost value. This does not apply to the surrender of goods if the deterioration of the goods is exclusively due to their inspection - as it would have been possible for you in a shop. In addition, you can avoid the obligation to pay compensation for any deterioration of the goods caused by the intended use of the goods by not using the goods as if they were your property and by refraining from doing anything that could impair their value. Goods that can be sent by parcel post are to be returned at our risk. You have to bear the costs of the return shipment if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of 40 Euros or if, in the case of a higher price of the goods, you have not yet provided the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise, the return shipment is free of charge for you.  Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your revocation declaration or the goods, for us with their receipt. End of the revocation instruction

4a. Return costs when exercising the right of revocation If you make use of your legal right of revocation (see revocation instruction), you have to bear the regular costs of the return shipment if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of 40 Euros or if, in the case of a higher price of the goods, you have not yet provided the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise, the return shipment is free of charge for you.

5. prices and shipping costs

5.1 The prices stated on the product pages include the statutory value added tax and other price components.
5.2 Information on additional shipping costs can be found in the shipping costs list.

6. delivery

6.1 Delivery is made within Germany, to countries of the EU and Switzerland, to other countries only on request.
6.2 The delivery times are not binding. Binding delivery dates require the written consent of Orangen-Bitter GbR.

7. payment

7.1 The payment is made as selectable in the order process.
7.2 You are only entitled to a right of set-off if your counterclaims have been legally established in court or are undisputed or have been acknowledged by us in writing.
7.3 You can only exercise a right of retention if the claims result from the same contractual relationship.

8. retention of title

The goods remain our property until full payment has been received.

9.text of the contract

The text of the contract is stored on our internal systems. You can view the general terms and conditions of business at any time on this page. If you have created a customer account, you can view your customer data at any time under 'Customer Login'. The order data will be sent to you by e-mail. After completion of the order the contract text is for security reasons no longer accessible via the Internet.
